18-1-704 Use Of Physical Force In Defense Of A Person

1. Except as provided in subsections (2) and (3) of this section, a person is justified

in using physical force upon another person in order to defend himself or a third person in order to defend himself or a third person from what he reasonably believes to be the use or imminent use of unlawful physical force by that other person, and he may use a degree of force which he reasonably believes to be necessary for that purpose.

2. Deadly physical force may be used only if a person reasonably believes a lesser degree of force is

inadequate and:

(a.) The actor has reasonable ground to believe, and does believe, that he

or another person is in imminent danger of being killed or of receiving great bodily injury; or

(b.) The other person is using or reasonably appears about to use physical force against an

occupant of a dwelling or business establishment while committing or attempting to commit

burglary as defined in sections 18-4-202 to 18-4-204; or

(c.) The other person is committing or reasonably appears about to commit kidnapping as defined in section 18-3-301 or 18-3-302, robbery as defined in section 18-4-301 or 18-4-302, sexual assault as set forth in section 18-3-402 or 18-3-403 as it existed prior to July 1, 2000, or assault as defined in sections 18-3-202 or 18-3-203.

3. Notwithstanding the provisions of subsection (1) of this section, a person is not justified in using physical force if:

physical force by that other person; or

(b.) He is the initial aggressor, except that his use of physical force upon another person under the

circumstances is justifiable if he withdraws from the encounter and effectively communicates to

the other person his intent to do so, but the latter nevertheless continues or threatens the use ofunlawful physical force; or

We are pleased to announce that the BluCore Shooting Center has opened a new retail only location near Austin TX! This new facility is just north of Austin in the Round Rock area. Address is below…

Originally, we wanted to expand in the Colorado market. The recently passed gun laws made us reconsider an expansion in Colorado. It would be nice to have another facility in CO someday, especially if efforts to repeal the restrictive gun laws succeed. For now, we have expanded into Texas!

In the future, we will be re-locating our Online Gun Store (BluCore Online Store) to Texas as well. This is also due to restrictive gun and magazine capacity laws. This change should be effective by 1 November. Colorado customers of our Online Store will still be able to select in-store pickup here in Colorado. We will have 2 locations for online shoppers to use as ‘in-store pick-up’ locations.

We intend to bring the same standards to our Austin location. We continue to ‘re-define the firearms experience’ here in Denver. We will always strive to improve. We will now bring that ethos with us to Austin. The same values that lead the BluCore Shooting Center – Denver to achieving the coveted NSSF 5-Start Rating as well as an A- Rating from the Denver / Boulder BBB!

Currently, the BluCore Shooting Center – Austin location is open Tuesday – Saturday, 10am – 6pm. The address is:

BluCore Shooting Center – Austin

2000 N. Mays St. – Suite #113

Round Rock, TX 78664

We are very excited for this new chapter and the challenges and opportunity that go along with it! We are also excited to support the economy in a state that has great respect for our 2nd Amendment. If you (our Colorado fans) want a new, larger facility in the great state of Colorado someday….write your elected officials and tell them NOT TO MESS WITH YOUR 2ND AMENDMENT!

If you are a fan of ours in the Austin Texas area and want to come check out Austin’s newest gun store, see the address above.

A press release on this matter is pending. We are also waiting to validate the new location on our Google Place & Yelp Accounts. More information to follow…..
